Terms of service

Statements can be discussed, but can only be changed BEFORE the payment of the commission.

 

1. General Terms

  • The drawing will contain a signature you may not remove under any circumstances.

  • I may stream and/or record the process at any point.

  • I hold the rights over my commissions to post it in galleries, use publicly, use for merchandise, etc.

  • My art will NOT be used for NFT's in any way, shape or form. Buying rights to my art does not allow you to turn it into an NFT.

  • I do not give permission to use my art for any AI use, training, or any other method involving AI. Buying rights to my art does not allow you to use it for any AI methods.

  • Prices are subject to change.

  • I reserve the right to decline or discontinue a commission at any time.

  • You have read this Terms of Service and the Commissions page. By commissioning me you agree upon everything that has been noted on said pages unless agreed otherwise in writing.

  • You agree that you own the rights to said character(s), drawing existing characters from media considered as "fan-art" can be agreed upon.

2. Payment

  • Payment is done through PayPal in euro.

  • I will ask 50% up front, the other 50% will be asked after the sketch phase. 100% up front is possible as well.

  • Don't send me any payment before I have agreed to your application and requested a payment.

​3. Process and delivery

  • You will be notified when I have started your commission, at this point you lose your rights to a refund (more info on refunds below).

  • During my work on the commission I will send you progress shots for you to review so everything is to your satisfaction.

    • You will be sent a sketch, which requires approval before moving on to the next stage.

    • You will be sent a coloured version of said sketch, which requires approval as well.

    • At this point I will work to finish the piece, progression shots can be requested.

  • Review shots will be smaller and watermarked.

  • Depending on the commission it can take from 2 weeks up until 3 months to finish the piece, depending on complexity, health and other similar factors.

  • You will be notified if there will be any delay.

  • Once the commission is finished you will receive a full size picture and a web version, unless you have asked for a traditional piece which will be mailed to you (shipping is paid by the customer, I am not responsible for any additional fees). If you would like a print of your digital work you can always ask!

 

4. Revisions

  • A fee will be charged if you want something changed on the finished drawing, unless it was made by my mistake.

  • If you wish to change something that had been previously approved, you will be charged extra based on hourly wage.

  • Unclear references will come with an extra charge. An example of an unclear reference is an excessively dark picture. I will give you a chance to provide me with better references if I deem them unclear.

5. Customer satisfaction

  • I will do my best to make you happy with your product!

  • If there are any issues, don't be afraid to communicate them to me so we can find a solution together.

  • Changes to the Terms of Service can be made if you wish, as long as it is before the payment.

 

6. Copyright / Usage policy

  • I, Leentje Vandenhende (the artist), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

    • Promote myself with it anywhere

    • Publish books with it (art books, etc)

    • Display it everywhere to my liking (website, social media, etc)

    • Post it wherever I want

  • The buyer is allowed to:

    • Use the commissioned piece for personal use unless agreed otherwise (you can upload it on social media profiles, forums, etc given you are crediting me).

    • Claim the character(s) as their own, but not the artwork itself.

    • Use the artwork to promote themselves. You do not need to credit me but it is greatly appreciated.

    • Use the the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.

  • The following is considered copyright infringement:

    • Reproducing/using the copyrighted artwork commercially, meaning you make money off it in any way.

    • Claiming the artwork as your own.

    • Removing my signature from the artwork.

    • Altering the artwork without consent.

I reserve the full right to the image and its use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time).

7. Refund/Cancellation policy

  • As soon as I start the commission, you will lose the right to a refund.

  • If you cancel the order before I have started, you will get a refund.

  • If I am unable to start the commission you will get a full refund.

  • Do not request a PayPal charge-back if you are getting refunded, I'll send you the money back myself.

  • Should you request a PayPal charge at any point, you will lose any previously mentioned rights to the commissioned work and I will keep the right to profit further from it in any way. I will decline the charge-back and will provide PayPal our conversation in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted.
